FIRST READING: July 16, 2019 SECOND READING: August 20, 2019 ORDINANCE NO. 6321 AN ORDINANCE SUBMITTING TO THE REGISTERED ELECTORS OF THE CITY OF LOVELAND AT THE CITY'S REGULAR ELECTION TO BE HELD ON NOVEMBER 5, 2019, A BALLOT MEASURE TO APPROVE A TAX INCREASE OF NOT MORE THAN SIX MILLION THREE HUNDRED THOUSAND DOLLARS AND A BALLOT MEASURE TO APPROVE A TAX INCREASE OF NOT MORE THAN FOUR MILLION TWO HUNDRED THOUSAND DOLLARS, IN THE FIRST FISCAL YEAR OF COLLECTIONS AND BY WHATEVER AMOUNTS ARE RAISED ANNUALLY THEREAFTER BY ADDITIONAL TEMPORARY SALES AND USE TAXES TO BE IMPOSED BEGINNING JANUARY 1, 2020 FOR CERTAIN PUBLIC IMPROVEMENTS WHEREAS, the City Council requested a study of options for capital projects with no funding source in January of 2017, and a Citizen Task Force ("Task Force") convened the same year; and WHEREAS, the Task Force considered a number of possible projects and funding options in 2018 and, after a hiatus, reconvened in 2019 and recommended at the May 28, 2019 City Council meeting that a half-cent ($.05 per $10 purchase) sales tax ballot measure be placed on the November 2019 ballot with a sunset after twenty-one years to fund eight projects; and WHEREAS, the City Council proposes two ballot measures, one would impose a temporary three-tenths of a cent ($.03 per $10 purchase) to fund the construction, operation, and maintenance of public improvements including the following: Renovation/Expansion of Fire Station #5, Replacement of Fire Station #3, Improve and Widen Taft Avenue and Eisenhower Boulevard (US-34), Recreation Trail Underpasses and Improvements, New Branch Library, and Museum Remodel and Expansion; and WHEREAS, one ballot measure would impose a temporary two-tenths of a cent ($.02 per $10 purchase) to fund the construction, operation, and maintenance of a New Community Recreation Center, which would include a senior center and aquatics facility, in Northwest Loveland and other recreational facilities; and WHEREAS, the City Council finds that major investments contribute to the quality of life and safety of the community, improve emergency response times, and expand access to art, library and recreation services; and WHEREAS, the City of Loveland's next regular election is scheduled for November 5, 2019; and WHEREAS, the Council must fix the ballot title for this measure, pursuant to Colorado Revised Statutes  31-11-111, to assure the title is not confusing, does not conflict with other measures on the ballot in the November 5, 2019 election, and correctly and fairly expresses the true intent and meaning of the measure; and WHEREAS, the Council finds that a two-tenths of one per cent sales tax ballot measure should be placed on the ballot for the next regular election to fund construction, operation, and maintenance of a new community recreation and senior center and that a three-tenths of one per cent sales tax ballot measure should be placed on the ballot for public improvements including road widening, renovation of a fire station and building a new fire station, a new library, renovation of the museum, and trail underpasses. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOVELAND, COLORADO: Section 1. That there shall be submitted to a vote of the registered electors of the City of Loveland on the ballot at the City's regular election to be held on November 5, 2019 the ballot issue of whether to increase sales and use tax by one-half per cent to fund the construction, operation, and maintenance of public improvements and sunset after twenty-one years. Section 2. That, in addition any other City ballot issue which may be approved by the City Council, the ballot for the City's regular municipal election on November 5, 2019, to be conducted as part of a coordinated mail ballot election with Larimer County, shall include the title and submission clause for a temporary increase in the sales and use tax as follows: AUTHORIZING A TEMPORARY ADDITIONAL SALES AND USE TAX OF 0.3% TO BE IMPOSED BEGINNING JANUARY 1, 2020, TO IMPROVE INFRASTRUCTURE AND PUBLIC SAFETY BY FUNDING CONSTRUCTION, OPERATION, AND MAINTENANCE OF PUBLIC IMPROVEMENTS. That, in addition to any other City ballot issue which may be approved by the City Council, the ballot for the City's regular municipal election on November 5, 2019, to be conducted as part of a coordinated mail ballot election with Larimer County, shall include the title and submission clause for a temporary increase in the sales and use tax as follows: AUTHORIZING A TEMPORARY ADDITIONAL SALES AND USE TAX OF 0.2% TO BE IMPOSED BEGINNING JANUARY 1, 2020, TO IMPROVE INFRASTRUCTURE AND QUALITY OF LIFE BY FUNDING CONSTRUCTION, OPERATION, AND MAINTENANCE OF A NEW COMMUNITY RECREATION AND SENIOR CENTER AND OTHER RECREATIONAL FACILITIES. That pursuant to C.R.S.  1-11-203.5, any election contest arising out of a ballot issue or ballot question election concerning the order of the ballot or the form or content of the ballot title shall be commenced by petition filed with the proper court within five days after the title of the ballot issue or ballot question is set. ORDINANCE NO. 6335 FIRST READING AN ORDINANCE ENACTING A SUPPLEMENTAL BUDGET AND APPROPRIATION TO THE 2019 CITY OF LOVELAND BUDGET FOR A REVISED FINANCIAL PLAN RELATED TO THE ACQUISITION OF THE PROPERTY AT 205 EAST 6TH STREET AND THE PARKING LOT AT 6TH STREET AND RAILROAD AVENUE WHEREAS, by adoption of Ordinance No. 6159 City Council appropriated $1,482,000 to the 2018 City of Loveland budget for the purpose of loaning such funds to the Loveland Urban Renewal Authority ("LURA") for the acquisition of the property located at 205 E. 6th Street and the parking lot at 6th Street and Railroad Avenue (the "Property") and for a related economic incentive to Longbow Industries, LLC (the "Incentive"); and WHEREAS, such funds appropriated in 2018 did not transfer to LURA in 2018 and were not re-appropriated by the City in 2019, in part because the Incentive was no longer needed; and WHEREAS, in lieu of using the funds appropriated by the City, LURA acquired the Property using internal funds derived from its three plan areas within LURA, although the acquisition was solely for the benefit of the Urban Renewal Plan for Block 41-Finley's Addition; and WHEREAS, in order to reimburse the other two plan areas and have only the Urban Renewal Plan for Block 41-Finley's Addition pay for the acquisition of the Property, LURA seeks a loan from the City of $366,000, rather than the $1,482,000 originally requested; and WHEREAS, the City has reserved funds not anticipated or appropriated at the time of the adoption of the 2019 City budget for a Revised Financial Plan Related to the Acquisition of the Property; and WHEREAS, the City Council desires to authorize the expenditure of these funds by enacting a supplemental budget and appropriaªtion to the 2019 City budget for a Revised Financial Plan Related to Acquisition of the Property, as authorized by Section 11-6(a) of the Loveland City Charter. FIRST READING: August 6, 2019 SECOND READING: August 20, 2019 ORDINANCE NO. 6323 AN ORDINANCE CONCERNING RECREATIONAL AND MEDICAL MARIJUANA AND SUBMITTING TO THE REGISTERED ELECTORS OF THE CITY OF LOVELAND AT THE CITY'S REGULAR ELECTION TO BE HELD ON NOVEMBER 5, 2019, TWO BALLOT ISSUES, ONE PERMITTING RETAIL AND MEDICAL MARIJUANA DISPENSARIES, CULTIVATION, MANUFACTURING, AND TESTING AND RESEARCH FACILITIES IN THE CITY AND THE SECOND IMPOSING AN EXCISE TAX OF UP TO 15% WHEN UNPROCESSED RETAIL MARIJUANA IS FIRST SOLD OR TRANSFERRED BY A RETAIL MARIJUANA CULTIVATION FACILITY AND IMPOSING AN ADDITIONAL SALES TAX OF UP TO 15% ON THE SALE OF RETAIL MARIJUANA AND RETAIL MARIJUANA PRODUCTS. WHEREAS, the City Council received information from staff, members of the public, law enforcement, and industry business owners on July 9, 2019 and decided to allow the citizens of Loveland to decide whether to allow retail and medical marijuana dispensaries, cultivation, manufacturing and testing and research facilities within the City of Loveland; and WHEREAS, marijuana may be taxed up to fifteen (15%) per cent with a vote of the citizens of Loveland at a regular election both by the imposition of an excise tax on the first sale of marijuana and an additional sales tax on marijuana; and WHEREAS, a majority of the City Council finds that the voters should decide whether to allow retail and medical marijuana dispensaries, cultivation, manufacturing, testing and research facilities in the City and for the City Council to regulate such activities by ordinances passed by the City Council; and WHEREAS, the City of Loveland's next regular election is scheduled for November 5, 2019; and WHEREAS, the City Council must fix the ballot titles for these measures, pursuant to Colorado Revised Statutes  31-11-111, to assure the titles are not confusing, do not conflict with other measures on the ballot in the November 5, 2019 election, and correctly and fairly express the true intent and meaning of the measures; and WHEREAS, the City Council finds that ballot measures should be placed on the ballot at the next regular election asking whether to permit retail and medical marijuana dispensaries, cultivation, manufacturing, and testing and research facilities in the City and whether to impose an excise tax of up to 15% when unprocessed retail marijuana is first sold or transferred by a retail marijuana cultivation facility and an additional sales tax of up to 15% on the sale of retail marijuana and retail marijuana products. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOVELAND, COLORADO: Section 1. The first asking whether to permit retail and medical marijuana dispensaries, cultivation, manufacturing, and testing and research facilities in the City, the second asking to impose an excise tax of up to 15% when unprocessed retail marijuana is first sold or transferred by a retail marijuana cultivation facility and an additional sales tax of up to 15% on the sale of retail marijuana and retail marijuana products subject to regulations to be passed by the City Council. Section 2. That, in addition to any other City ballot issue which may be approved by the City Council, the ballot for the City's regular municipal election on November 5, 2019, to be conducted as part of a coordinated mail ballot election with Larimer County, shall include the title and submission clause to authorize the sale of medical and retail marijuana within the City as follows: AUTHORIZING RETAIL AND MEDICAL MARIJUANA DISPENSARIES, CULTIVATION, MANUFACTURING, AND RESEARCH AND TESTING FACILITIES TO BE LOCATED WITHIN THE CITY. SHALL THE CITY COUNCIL BE AUTHORIZED TO PERMIT RETAIL AND MEDICAL MARIJUANA DISPENSARIES, CULTIVATION FACILITIES, AND MANUFACTURING, AND RESEARCH AND TESTING FACILITIES TO BE LOCATED IN THE CITY SUBJECT TO REGULATIONS TO BE PASSED BY THE CITY COUNCIL? Section 3. ORDINANCE NO. 6330 FIRST READING AN ORDINANCE APPROVING A SECOND AMENDMENT TO THE ZONING DOCUMENT PERTAINING TO LOT 1, BLOCK 2, MINERAL FIRST SUBDIVISION WHEREAS, Spiritual Bean, LLC (the "Applicant"), as owner of the real property described herein, has filed an application for a second amendment of the Zoning Document pertaining to Lot 1, Block 2, Mineral First Subdivision (the "Property") to expand the list of allowable uses for the Property to include a restaurant with a drive-through in order to construct a Ziggi's caf? with drive-through; and WHEREAS, the Property is located within the Mineral Addition in the City of Loveland which is zoned PUD. The Property is subject to the Mineral Addition Preliminary Development Plan, which plan is now known as a "Zoning Document" under the City's Unified Development Code. The Preliminary Development Plan was previously amended once; and WHEREAS, the proposed expanded allowable uses for the Property are reflected in a proposed Lot 1, Block 2 Mineral First Subdivision Zoning Document Amendment 2 (the "Second Amendment"), a copy of which is on file with the City's Current Planning Division and is incorporated herein by reference; and WHEREAS, after holding a duly-noticed public hearing on July 22, 2019, the City of Loveland Planning Commission made the findings listed in the Planning Commission staff report dated July 22, 2019 and based on those findings recommended that the City Council approve the Second Amendment subject to one condition regarding orientation of the drive-through restaurant if developed; and WHEREAS, the City Council desires to approve the Second Amendment to confirm the expanded list of allowable uses for the Property to include a restaurant with drive-through. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOVELAND, COLORADO: Section 1. That the City Council hereby finds that the Second Amendment complies with the standards for zoning documents set forth in Section 18.17.08.07(G) as follows: a. The Second Amendment is consistent with the policies and goals of the City of Loveland Comprehensive Plan, any applicable adopted area plan, or community plan of the City, or reflects stated conditions that have changed since the adoption of the Comprehensive Plan; b. The Second Amendment either: i. Advances the following policy objectives: 1. Promoting more economical and efficient use of land while providing a harmonious grouping of a variety of land uses; 2. Allowing for a project that assists in the implementation of adopted City plans (and not as a device to circumvent the standards of this UDC and good planning practice); 3. Addressing a unique situation or conferring a substantial benefit to the City; or ii. The creation of a PUD zone is the only practical way to avoid completely prohibiting a legal, permitted business use within the City. c. The PUD complies with all applicable City standards not specifically modified or waived by the Second Amendment; d. The PUD is integrated and connected with adjacent development through street connections, sidewalks, trails, multi-use pathways, and similar features; e. To the maximum extent possible, the Second Amendment mitigates any potential significant adverse impacts on adjacent properties or on the general community; f. Sufficient public safety, transportation, and utility facilities and services are available to serve the subject property, while maintaining sufficient levels of service to existing development; g. The same development could not be accomplished through the use of other techniques, such as complete neighborhood development, application of the Enhanced Corridor Overlay Zone, height exceptions, variances, minor modifications, or a PUD is a preferable way to regulate the subject property due to its large land area or multi-year build-out schedule; and h. As applicable, the proposed phasing plan for development of the PUD is rational in terms of available infrastructure, and capacity. Section 2. That the City Council hereby approves the Second Amendment subject to the following condition: If the Property is developed as a drive-through restaurant, the site shall be oriented in a manner generally consistent with the conceptual rendering on Sheet A1 of the Second Amendment. Section 3. That the Lot 1, Block 2 Mineral First Subdivision Zoning Document Amendment 2 shall be subject to the Mineral First Subdivision Preliminary Development Plan, as amended. Section 4. That the Lot 1, Block 2 Mineral First Subdivision Zoning Document Amendment 2 remains subject to any applicable Annexation and/or Development Agreement, as the same may be or have been amended from time to time. Section 5. That the Lot 1, Block 2 Mineral First Subdivision Zoning Document Amendment 2 shall be subject to all applicable zoning regulations of the City of Loveland, except where they conflict with the Mineral First Subdivision Preliminary Development Plan, as amended, and any Final Development Plan applicable to the Property. Section 6.
